HC dismisses plea of man convicted of abetment in suicide of married lover

IMPHAL, Oct 31: A single bench of N Kotiswar Singh, High Court of Manipur, while upholding the verdict of the Session Judge Manipur West, on Thursday dismissed the plea of a man who was convicted in the death case of a girl who died after consuming poison in 2002, and directed the accused to surrender within a week.

The single bench also directed the accused to serve out the remaining sentence after vacating the earlier order of stay of the judgement.

Elangbam Nanaocha alias Naocha alias Tombi, 28, of Wangjing Lamdhing, was convicted by the Session Judge Manipur West in 2009 sentencing him to three years in prison and imposing a fine of Rs 50,000 to be paid to the victim’s family.

On July 4, Ningthoujam Sandhyarani Devi, 22, wife of Nipamacha of Wangjing Lamdhing under Thoubal Police Station succumbed at Regional Institute of Medical Sciences (RIMS) after consuming poison.

Sandhyarani Devi and Nanaocha had  a love affair for over four years. She was first rushed to Thoubal Hospital and later referred to RIMS as her condition deteriorated.

Prima facie evidence pointed that the deceased was in the company of the accused till the episode of hospitalisation and right before the incident of consumption of poison took place following which a case was framed against the accused under Section 306 IPC.

As per the prosecution, Elangbam Nanaocha was alleged with direct or indirect involvement of abetting the commission of suicide. The accused abetted the suicide as she was mentally disturbed by the refusal of the accused to elope with her (deceased) who was reported to be pregnant by the time.

However, the defendant pleaded that the victim consumed poison at her house due to quarrel with her family members and came to the accused who was working at his gate.

After further cross examination of the Prosecution witnesses (Prosecution witness 18 and defense witness 3) and Defender witness recorded with the police, the accused was proved for the charges framed against him.

Following the facts and circumstances leading to the commission of suicide, the accused was convicted under section 306 of the Indian Panel Code by the session judge.
